Pre-Trial Therapy: Working at the Intersection of Mental Health & Criminal Justice Systems

Supporting clients to psychologically navigate the criminal justice process as victims of crimes can be challenging work. When therapy notes are requested as evidence (usually for sexual and domestic abuse cases) we can struggle to know how to follow the Crown Prosecution Service (CPS) guidelines on ‘pre-trial therapy’.
Working at the intersection of mental health and criminal justice systems can therefore feel confusing, conflicting, and emotionally difficult for both therapists and clients.
Using trauma-informed and empowerment-based approaches, we will explore:
- Our position within the intersection of the mental health and criminal justice systems
- What pre-trial therapy is (and isn’t)
- The legacy of the CPS pre-trial therapy guidelines and significant changes made in 2022
- Survivor experiences of reporting
- Contracting, note taking, and managing requests/court orders for notes
- First disclosures and appearing in court
- Considerations in relation to the Information Commissioner’s Office, GDPR guidance, and therapeutic ethical frameworks
- Ways to empower ourselves and clients, including those from minoritised communities.
This experiential workshop will include a combination of information to practically support your work, space to explore embodied responses to the material, and thinking collaboratively as colleagues.
